Privacy statement
1. Who we are
Kintsu is a brand of Profility BV, Bergemeersenstraat 118, 9300 Aalst, enterprise number 0534.390.321. Profility BV is responsible for the processing of your personal data as described in this statement. You can send your questions to contact@kintsu.be.
2. What this statement covers
This statement covers the personal data that Kintsu itself processes: of people who make a request, of prospects, of customers and of visitors to kintsu.be.
For the data that visitors leave on a customer's website, the customer is the controller and Kintsu is the processor. For that data, our general terms and conditions (art. 14) and that customer's privacy statement apply.
3. What data we process and why
3.1 Requests. If you request a proposal via kintsu.be, we receive your name, your email address and the address of your website. We use these to answer your request and to make a proposal. We do this at your request, before we enter into an agreement.
3.2 Prospects. We also make proposals for businesses that did not ask for one themselves. For this, we use what is publicly available on your website: your texts, images and contact details, and the general email address of your business to send you the proposal. We do this on the basis of our legitimate interest in presenting our offer to businesses. You receive a personal link to a preview of your new website. In this context, we record when that link was opened, whether you viewed the preview, with which browser, and what you tell us via that page, such as your phone number or your answers to our questions. We only use this to follow up on your proposal. We do not store your IP address for this. If you do not want this, let us know: we will then stop immediately.
3.3 Customers. If you become a customer, we process your contact details, our correspondence and your invoices. We do this to perform our agreement and because the law requires us to keep accounts.
3.4 Contact. If you email us, we use your data to reply to you.
3.5 Visits to kintsu.be. Our hosting processes technical data, such as your IP address and your browser, to display and secure the website. We do not use this data to track you. For the preview of a proposal, see 3.2.
We never sell your data and do not use it for purposes other than those above.
4. Who we share data with
We only share your data with parties we need for our service:
- Microsoft, for email and the hosting of kintsu.be;
- Webflow, Inc., for the proposals and the websites of our customers;
- the suppliers of the software we use to analyse websites and rewrite texts;
- our accountant.
Webflow stores data in the United States, under the EU-US Data Privacy Framework and the standard contractual clauses of the European Commission. The same safeguards apply to other suppliers outside the European Union.
If we have to provide data to a public authority because the law requires it, we do so.
5. How long we keep data
- A request or a proposal that did not lead to an agreement, with what we recorded about the preview: two years after the last contact.
- Customer data: for as long as the agreement runs, and after that for as long as necessary for a possible dispute.
- Invoices and accounting records: for as long as the law requires.
6. Your rights
You can always ask us what data we hold about you, and have it corrected or erased. You can object to processing, have it restricted or take your data with you. To do so, send an email to contact@kintsu.be. We reply within one month.
If you are not satisfied with how we handle your data, you can lodge a complaint with the Data Protection Authority (www.gegevensbeschermingsautoriteit.be).
7. Security
We protect your data with appropriate measures: encrypted connections, access only for those who need it, and reliable suppliers.
8. Changes
We update this statement when our way of working changes. The date at the top shows the latest version.
9. Cookies
Kintsu.be does not use cookies, with one exception: on the preview of a proposal, we set a functional cookie, kintsu_sessie. It remembers your session, so that if you return within the hour, you can continue where you left off. It disappears after an hour and is not used to track you.
